This Privacy Policy describes the privacy practices of turbopuffer Inc. (“turbopuffer”, “us”, “we”, “our”) including details of how we handle personally identifiable information (“Personal Information”) that we collect through our website, www.turbopuffer.com (“Website”) our platform, and through our service offerings that link to this Privacy Policy (collectively, “Services”). Please read the following carefully to understand our practices regarding Personal Information of users who access and/or use our Services (each a “User”, “you”, “your”).

  1. Consent. By accessing or using the Services, you consent to the collection, use and disclosure of your Personal Information as described in this Privacy Policy. Except as set forth in this Privacy Policy, your Personal Information will not be collected, stored, used, or disclosed for any other purpose without your consent. Please note that any Personal Information we handle on behalf of our enterprise customers as a service provider or processor may be subject to separate terms with such enterprise customers which may differ from the terms of this Privacy Policy.
  2. Note on Minors. Our Services are not intended for use by minors under 16 years of age. If we learn that we have collected Personal Information through the Services from a child under 16 without the consent of the child’s parent or guardian as required by law, we will delete it.
  3. Information We Collect When You Use the Services.
    1. You may provide to us or we may collect contact details such as your first name and last name, email address, mailing addresses, phone numbers and business contact information. For paying users, we collect payment information needed to complete your transactions with us, including name, payment card information, and billing information. This information is processed by our payment service provider who may handle your payment information in accordance with its own privacy policy). We do not have access to your full payment card information. Through the Services we may also capture and process the following types of information about you:

      1. Communications that we exchange with you, including when you contact us with questions, feedback or otherwise.
      2. Survey information that you provide when you participate in one of our surveys.
      3. Usage information, such as information about how you use the Services and interact with us, including information associated with any content you upload to the Services or otherwise submit to us, and information you provide when you use any interactive features of the Services
      4. Marketing data, such as your preferences for receiving our marketing communications and details about your engagement with them.
      5. IP address, type of user, location coordinates and other device information; and
      6. any other information that may be requested as part of our Services. It is always your choice whether or not to provide Personal Information but if you choose not to provide certain requested Personal Information, in some instances you may not be able to register to use the Service or be able to access and use the Service at all. In other instances, your choice not to provide certain other Personal Information may mean that you will not be able to use certain features of the Service.
    2. Cookies and Automatic Data Collection. When you use the Services, turbopuffer may collect certain information through technologies such as cookies and other automatic data collection technologies (“Cookies”). We may use Cookies for authentication and to compile aggregate statistics about usage of the Services, such as how long Users spend using the Services, and what parts or pages of the Website are viewed most often. This information is used to improve the content and operation of the Services. We may also use Cookies to promote the Services through marketing and advertising. These Cookies may be accessed or disclosed to third parties for the purpose of serving you relevant advertisements. You may opt out of Cookies or prevent third-party websites from accessing our Cookies by adjusting your privacy settings on your browser. However, opting out of Cookies may disable some features of the Services and may prevent us from providing you with the information and services you have requested.
    3. Third-Party Integrations. We may integrate with or rely on third-party platforms and services to provide the Services to you (“Third-Party Integrations”). Any Personal Information submitted to us via Third-Party Integrations that we can access will be subject to this Privacy Policy, but please note that such Personal Information will also be subject to the terms of the applicable Third-Party Integration.
  4. How We Use Information We Collect.. We use Personal Information for legitimate business purposes including in the following ways:
    1. To authenticate and provide you access to the Services;
    2. To analyse, provide, maintain, improve, and enhance the Services (including security of the Services) and as part of these activities, we may create or use aggregated, de-identified or other anonymized data from Personal Information we collect. We make personal information into anonymized data by removing information that identifies the individual. We may use this anonymized data and share it with third parties for our lawful business purposes, including to analyze and improve the Services and promote our business; To communicate with you, provide you with updates and other information relating to the Services, provide information that you request, respond to comments and questions, and otherwise provide customer support;
    3. Personalization of the Services through assessing and better understanding your needs and interests;
    4. For compliance purposes, such as to enforce the terms of our Services, for internal audits for compliance with legal and contractual requirements and our internal policies and as may be required by applicable laws and regulations or requested by any judicial process or governmental agency or to defend ourselves against legal claims or disputes;
    5. To investigate and protect against fraudulent, harmful, unauthorized or illegal activity;
    6. Marketing and advertising unless you have opted out of receiving marketing communications; and
    7. For other purposes for which we provide notice at the time the Personal Information is collected.
  5. Who We Share Your Information With. We may share your Personal Information with our employees, contractors and with third parties, while performing our contractual obligations. These third parties may include web hosting partners, IT service providers, and advertisers. We have put in place contractual and other organizational safeguards with such third parties to protect your Personal Information from unauthorized uses and disclosures. Such third parties have limited access to Personal Information solely for the purposes described herein, and they will be subject to contractual restrictions prohibiting them from using such Personal Information for any other purpose.     Our servers and those of third parties who may receive your Personal Information may be located outside of Canada. Accordingly, your Personal Information may be available to foreign governments or their agencies under a lawful order, irrespective of the safeguards we have put in place for the protection of your Personal Information.

  6. Third Parties. The Services may contain links to third-party websites, products, or services that we do not own or operate. We are not responsible for the privacy practices of these third parties. Please be aware that this Privacy Policy does not apply to the collection, storage, use, and disclosure of your Personal Information by such third parties.
  7. Data Retention and Deletion. We will keep your Personal Information for as long as you use our Services. All retained Personal Information will remain subject to the terms of this Privacy Policy. You have the right to ask us to remove your Personal Information from our databases, and we will do so to the best of our ability, but it may not be possible to completely delete all of your Personal Information due to technological and legal constraints (for example, when your Personal Information pertains to another User).
  8. Access and Accuracy. You may access the Personal Information we hold about you to verify accuracy of your Personal Information, to have a general account of our uses of your Personal Information, and to correct your Personal Information as appropriate. Upon receipt of your written request, we will provide you with a copy of your Personal Information although in certain limited circumstances, we may not be able to make all relevant Personal Information available to you (for example, where that Personal Information also pertains to another User). In such circumstances, we will provide reasons for the denial to you upon request. We will make every reasonable effort to keep your Personal Information accurate, and to respond to your in a timely manner.
  9. Marketing. You may opt out of marketing-related emails and other communications by following the opt-out or unsubscribe instructions in the communications you receive from us or by contacting us as provided in the “Contact Us” section below. We may continue to send you service-related and other non-marketing emails.
  10. Security. We use commercially reasonable efforts to store and maintain your Personal Information in a secure environment. We take technical, contractual, administrative, and physical security steps designed to protect Personal Information that you provide to us. We have implemented procedures designed to limit the dissemination of your Personal Information to only such designated staff and third parties as reasonably necessary to carry out the stated purposes we have communicated to you.
  11. Updates. We reserve the right to modify this Privacy Policy at any time. If we make material changes to this Privacy Policy, we will notify you by updating the date of this Privacy Policy and posting it on our Website.
